Terms of Use and Disclaimer

This Disclaimer governs your use of the TeamSports mobile and web apps, the manager CMS, and related services (the "Service") provided by Team Sports Management Inc ("TeamSports", "we", "us"). By using the Service you accept this Disclaimer in full, including Sections 4 to 6.

1. "As is" — no warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

2. No professional advice

TeamSports is a team-organization and scheduling tool. It does not provide medical, health, fitness, coaching, legal, or safety advice. Nothing in the Service is a substitute for professional judgment. Always consult a qualified professional (for example, a physician before starting physical activity).

3. Sport and physical-activity risk

Participation in sports and physical activity carries inherent risks, including injury. TeamSports only helps organize and communicate about activities; it does not supervise, coach, officiate, or ensure the safety of any activity, venue, or participant. You and, for minors, their parents/guardians, assume all risks of participation. Responsibility for the safety and supervision of participants rests with the teams, coaches, managers, parents, guardians, and venue operators involved — not with TeamSports.

4. Prohibited content and conduct

Teams, schedules, rosters, scores, messages, photos, and other content are created by users. You are solely responsible for content you submit and for your conduct on the Service.

You may not post, upload, or send content, or behave in a way, that:

• is harassing, bullying, or threatening toward any person;
• is hateful or discriminatory, including on the basis of race, ethnicity, religion, gender, sexual orientation, disability, age, or similar characteristics;
• is sexually explicit;
• depicts or promotes the sexual abuse or exploitation of children. We have zero tolerance for this content: we remove it, close the account, and report it to the authorities, including the National Center for Missing & Exploited Children where required;
• depicts, promotes, or threatens violence or self-harm;
• impersonates another person or organization;
• is spam, a scam, or unsolicited promotion;
• shares another person's private information (such as an address, phone number, e-mail address, or photo of someone who has not agreed) without their permission, and in particular photos or details of minors outside their own team;
• infringes the rights of others; or
• is otherwise unlawful.

The Service is used by teams that include minors. Take particular care with anything that shows or concerns a child, and see Section 7 of our Privacy Policy.

5. Reporting and blocking

Every photo, profile, team, event, and comment can be reported in the app and on the web (open the menu and choose Report). You can also block a person (Settings, then Blocked users): their photos, roster entries, and notifications are no longer shown to you, and they cannot invite you or find you in search. Blocking is not announced to the person you block.

Reports reach us in confidence. We do not tell the reported person who reported them. We review reports and act on them as we judge appropriate. To reach us directly, write to administrator@teamsports.me.

6. Removal and suspension

We may remove content, restrict features, and suspend or close accounts, at our discretion and without notice, if you breach Section 4 or if we need to do so to protect other users. Repeated or serious breaches result in permanent removal. If you believe we acted in error you may appeal by e-mail to administrator@teamsports.me. Removal does not limit any other remedy available to us.

7. Accuracy of information

We do not author, verify, endorse, or guarantee the accuracy, completeness, timeliness, or appropriateness of user content — including game times, locations, scores, and roster details. Confirm important details (such as event times and venues) directly with your team.

While we aim to keep the Service working and information current, we make no representation that any information shown (schedules, standings, statistics, search results, maps/venue data) is accurate or up to date. Mapping and location data is provided by third parties and may be incomplete or inaccurate.

8. Third-party services and links

The Service integrates with and links to third-party services (including Google, Apple, Facebook, and Google Maps). We do not control and are not responsible for the content, policies, availability, or practices of those third parties. Your use of them is at your own risk and subject to their terms.

9. Availability

We may modify, suspend, or discontinue any part of the Service at any time without notice or liability. We are not responsible for any loss arising from unavailability of the Service or loss of data.

10. Limitation of liability

To the maximum extent permitted by law, TeamSports and its officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or related to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us in the 12 months before the claim, or USD $100.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

11. Indemnity

You agree to indemnify and hold harmless TeamSports from claims, damages, and expenses arising from your content, your use of the Service, or your breach of this Disclaimer (including Sections 4 to 6) or our terms.

12. Governing law

This Disclaimer is governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules.
